After the publication of the Spanish General Law on Telecommunications in June in the Spanish Official Gazette, which will be in force from 1 November, operators shall be obliged to modify the mobile telephony contracts of their customers.

Permanence and contract term.
With respect to permanence, indefinite contracts disappear, giving way to contracts of a maximum of 24 months that can be extended, a measure that has been very well received by the different consumer and user organizations.
Cancellation of the contract without penalty.
In case the operator decides to raise their fees, which leads to a higher cost for consumers, they are entitled to cancel the contract immediately, without penalty and regardless of the permanence.
An important nuance to take into account in this regard is if the customer has acquired a terminal financed by the operator, in 48 monthly instalments, for example. In such cases, although the contract is for a maximum of 24 months, if the customer cancels the contract without paying all the instalments, they must pay the pending amount or return the device, depending on the contractual conditions.
Free portability?
It is also established that the change of operator by the customer, keeping the same telephone number, must be free of charge. To date, in most cases, the receiving operator of the portability assumes this expense. Otherwise, it would discourage the customer from changing companies.

Despite the actions mentioned above, the new Spanish General Law on Telecommunications still has a long legislative road to travel. More than 90 royal decrees and ministerial order for the concretion of the law has not been passed yet, and crucial topics like the deployment of network and infrastructures are still pending.
